Terms of Service

1. Acceptance of Terms

By accessing or using Evermail ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Evermail.

2. Description of Service

Evermail is a cloud-based email archiving and search service. It allows users to upload email archive files (.mbox, PST, EML, Google Takeout, etc.) and search their contents, optionally using AI-powered features. The Service is hosted in EU data centres.

3. Eligibility

You must be at least 16 years of age to use the Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration

You must create an account to use the Service. You are responsible for:

• Keeping your login credentials secure.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised use at security@evermail.ai.

5. Acceptable Use

You agree not to use the Service to:

• Upload email archives you do not have the legal right to upload and search.
• Violate any applicable law or regulation.
• Attempt to gain unauthorised access to other users' data or our systems.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service to store or process data that is illegal under EU or applicable national law.
• Introduce malware, viruses, or other harmful code.

6. Subscription Plans and Billing

Free plan

The Free plan is provided at no cost. Data is automatically deleted 30 days after upload. We reserve the right to modify or discontinue the Free plan with 30 days' notice.

Paid plans

Paid subscriptions are billed monthly or annually via Stripe. All prices are listed in EUR and exclude VAT where applicable. VAT is calculated automatically by Stripe Tax for EU customers.

Renewals and cancellations

Subscriptions renew automatically unless cancelled before the renewal date. Upon cancellation, access continues until the end of the paid period, followed by a 30-day export grace period. After the grace period, all data is permanently deleted.

Refunds

We offer a 14-day money-back guarantee on first-time purchases of paid plans. Annual plan refunds after 14 days will be pro-rated for unused months at our discretion.

7. Data Ownership and Licence

You retain full ownership of all email data you upload to the Service. By uploading data, you grant Evermail a limited, non-exclusive licence to store, index, and process your data solely for the purpose of providing the Service to you. We do not claim ownership of your data and do not use it for advertising or AI model training.

8. Data Processing

Our processing of your personal data is governed by our Privacy Policy and, for business customers, a Data Processing Agreement (DPA) is available upon request at privacy@evermail.ai.

9. Service Availability

We aim to provide 99.5% uptime for Pro plans and 99.9% for Enterprise plans. These SLAs are defined in the relevant plan documentation. Planned maintenance will be communicated in advance. Free and Starter plans have no uptime SLA.

We reserve the right to modify, suspend, or discontinue the Service with reasonable notice (except for critical security or legal reasons, which may require immediate action).

10. Intellectual Property

The Service, including its software, design, trademarks, and all other intellectual property, is owned by Evermail and protected under applicable law. You may not use our name, logo, or branding without prior written consent.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Evermail shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, or business opportunities.
• Service interruptions beyond our reasonable control.

Our total liability for direct damages shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.

12. Termination

We may suspend or terminate your account if you materially breach these Terms and fail to remedy the breach within 7 days of notice. You may terminate your account at any time by cancelling your subscription and deleting your account in settings.

13. Governing Law and Disputes

These Terms are governed by the laws of Finland and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Finland, without prejudice to your rights as an EU consumer to bring proceedings before courts in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
